Custom Order Contract

This Custom Order Contract (the "Agreement") is entered into by Yeah Baby Bakes located at 131 S.Union St. #2 Spencerport, NY 14559  and (the "Client"). Yeah Baby Bakes agrees to produce custom order as agreed upon and on time. The client agrees to pay Yeah Baby Bakes for the production of the order. The following terms and conditions apply:

1. A nonrefundable deposit of 50% is required to place an order and secure a pickup date. The remaining balance is due before or at pickup. Any changes to the order are subject to availability and must be made in writing no later than two (2) weeks prior to pick up date and may incur additional charges. 

2. Yeah Baby Bakes is not responsible for any damages to the order once it leaves our facility caused by a guest, caterer, or any other person not employed by Yeah Baby Bakes. Please follow product care directions included with your order, keeping macarons refrigerated or frozen until the day of the event. Macarons are not suggested for hot outdoor events.

3. Client assumes full responsibility for the event guests and agrees to indemnify and hold Yeah Baby Bakes harmless from and against all bodily injury, property damage, or consequential damages.

 4. Yeah Baby Bakes products may contain or come in contact with milk, wheat, nuts, soy, eggs, cocoa, wheat, or other allergens. Yeah Baby Bakes is NOT a certified gluten-free kitchen. While every precaution will be taken in the cases of known allergies, it remains the full responsibility of the Client to inform guests of possible allergens. All orders will include an allergen alert sticker. Yeah Baby Bakes is not responsible for any allergic reactions.

5. Performance of this agreement is contingent upon the ability of Yeah Baby Bakes to complete the agreement and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control.

 6.Yeah Baby Bakes reserves the right to use any photographs of the finished macarons or towers for promotion without compensation.
